Court approves Vermont attorney general’s $55,000 HIPAA settlement with Health Net

first_imgJudge William K Sessions has approved Attorney General William Sorrell’s proposed settlement with Health Net, Inc., and Health Net of the Northeast, Inc., regarding the health insurance company’s loss of an unencrypted portable hard drive containing protected health information. The State’s complaint alleged violations of HIPAA (the Health Insurance Portability and Accountability Act), Vermont’s Security Breach Notice Act, and Consumer Fraud Act. The settlement approved by the court on Friday requires the defendants to pay $55,000 to the State, submit to a data-security audit, and file reports with the State regarding the company’s information security programs for the next two years.The lawsuit is Vermont’s first enforcement action under the Security Breach Notice Act and the second HIPAA enforcement action of its kind since state attorneys general were given HIPAA enforcement authority in 2009. The case arises from a portable hard drive that contained protected health information, social security numbers, and financial information of approximately 1.5 million people, including 525 Vermonters. Health Net discovered that the drive was missing on May 14, 2009 and did not start notifying affected Vermont residents until more than six month later. When it did notify Vermont residents, Health Net told them that it believed their risk of harm was ‘low’ because ‘the files on the missing drive were not saved in a format that can be easily accessible.’ The files on the unencrypted drive were in TIF (Tagged Image File) format, which can be viewed using a variety of freely available software.Health Net, Inc., and Health Net of the Northeast, Inc., cooperated with the Vermont Attorney General’s investigation of this matter and have settled similar actions in Connecticut and New York. January 26, 2011last_img read more

first_imgDuro IkhazuagbeNigerians who are waiting for the exit of Franco-German Gernot Rohr from the Super Eagles job may heave sigh of relief soon as four African countries want to hire him.Rohr, 66, led Super Eagles to the semi final of the just concluded 32nd Africa Cup of Nations in Egypt and won the bronze with a 1-0 defeat of Tunisia in the Third Place match last Wednesday. However, since Nigeria failed to reach the final, there have been calls for the termination of Rohr’s contract. He is largely perceived to have failed at the tournament despite meeting the target of a semi final finish at Egypt 2019.THISDAY learnt at the weekend that Morocco and three other countries have made enquiries about the gaffer and want to hire him.If the coach accepts to leave, this will save the NFF the payment of the $1million pay off clause in his contract that is not due to expire until next year.Despite the clamour for Rohr to be sacked from the Eagles job, an insider at the Glass House in Abuja confided in THISDAY that the federation does not have the capacity to cough out N360 million to pay off the coach. “Where will NFF bring the $1million pay off clause in Rohr’s contract to end the romance with him even though I am aware that the leadership of the federation is no longer confortable with the man’s tactics,” a top football administrator confided in THISDAY yesterday from Abuja.When asked if there was no way the contract can be terminated without having to pay Rohr, the official who spoke on condition of anonymity blamed NFF’s legal department for setting a semi final target for the coach while reviewing the contract after qualifying Nigeria for the World Cup in Russia last summer.“Nigeria is a big country in African football. I don’t know why anybody will set an AFCON semi final target for Gernot Rohr? We have won the AFCON title on three occasions, reached the final about four times and won the third place eight times with the bronze from Egypt on Wednesday. Winning the title in Egypt would have been the target otherwise we will not be in this situation now,” observed the official.He dismissed the tactics adopted by the coach in Egypt as poor and unfamiliar with Super Eagles flair.“I don’t want to hear all these talks of young team, young team any more. Our Eagles were simply poor in tactics despite winning the third place match against Tunisia. This is probably one of the most asked questions in any gym.Everyone has their own ideal waistline and they will always aspire to try and get that ‘look’, especially when summer is around the corner.Most men want the six pack abs and most women would love to have a long, lean and tight tummy. Walk into any gym or health club at any time of the day and you will likely find a number of people laying on their backs with their legs in the air (take your mind out of the gutter) crunching away for all they are worth in the hopes of reducing their waist line or getting a set of chiselled abs.There is a lot of misinformation when it comes to abdominal training.Turn on any TV and flick through some of the shopping channels and you will be met with a variety of gadgets and gizmos, all of them with models with unbelievable bodies, “Ab-swinging”, “Ab-crunching”, “4 minute-Abing” and even “ab rolling”.Go online and you will be met with the over enthusiastic ‘Mike Chang,’ the only millionaire on YouTube who cannot afford a shirt. All of these products promise that you will get the results that you are after, but all of them will fail to deliver.Why then are they so hard to attain?What is it that holds us back from getting to where we want to be?Here are a few tips on the best ways to train your Abs.1. Use compound Exercises.Large exercises like squats, deadlifts and overhead pressing are probably the best exercises that you can do for your Abs. Every inch of your core will fully engage during these exercises and you are also working your full body at the same time.2. Only doing sit upsPeople like sit ups because whenever they do a lot of them, their abdominal muscle will burn and this means that it is working…..right?Not quite, our abdominal muscles are made to do an array of movements; we can flex, bend, twist and turn and they support us through core stability.Our abdominal training should reflect this. Planks, side planks, reverse crunches, hanging leg raises, rollouts, pikes, pallof presses, cable crunches, X body mountain climbers, cable chops, hyper-extensions etc, etc, etc.These are only a few choice exercises that you can do to hit your core from different angles and help train it properly.3. Thinking you can out train your dietIt doesn’t matter how many sit ups you do. It doesn’t matter how much cardio you do. Your dietary and weekend habits will dictate whether you can see your abdominal muscles or not.Some people have good genetics and can see visible abs with a slightly high body fat, but most people have to be in a lower range before all their hard work will finally reveal itself.4. Training your abdominal muscles every day.Your abs are a muscle like any other muscle.
